§ 13-112. Responsibility for cleanup costs, damages.

  • Any person responsible for the depositing or discarding of hazardous or other regulated liquid, semiliquid, or solid waste upon any sidewalk, alley, street, bridge, public passageway, drain, gutter, waterbody, or other public or private property shall be responsible for any costs associated with the cleaning up or removal and disposal of such materials. Such person shall also be responsible for reimbursing the city for any costs/damages incurred by the city. These costs/damages may include, but are not limited to, manpower, equipment, supplies, analytical costs, disposal costs, consultants, private contractors, and street/utility repairs. The city manager is hereby authorized to direct the city attorney to file such claims, lawsuits, and/or liens as necessary to collect such costs/damages.
