Chapter 23. STREETS, ALLEYS, SIDEWALKS, EASEMENTS AND OTHER PUBLIC WAYS |
Article I. IN GENERAL |
§ 23-10. Same—Conditions to be found for abandonment.
No public property shall be vacated and abandoned by the city unless, after the hearing provided for herein, the city council shall find that:
(1)
The abandonment and vacation of such property is to the best interest of the citizens of the city.
(2)
No person or property shall be materially damaged by such abandonment and vacation.
(3)
The person requesting such abandonment or vacation is willing to pay all the cost of the proceedings held hereunder and such other costs as might be necessary to complete such abandonment and vacation.
(4)
The person requesting such abandonment and vacation is willing to furnish such additional assurance to the city as may be deemed necessary by the city council to protect the interests of the city in regard to such abandonment and vacation.
