§ 30-28. Books and records.

  • (a)

    A grantee shall provide, within twenty (20) business days, a current list of its shareholders holding ten (10) percent or more of the outstanding stock or equivalent ownership interest, as well as a roster of its principals or officers and directors and their addresses, upon request by the city.

    (b)

    A grantee shall maintain an office in the city for so long as it continues to operate a system or any portion thereof in the city. A grantee shall designate an office as the place where all notices, directions, orders, and requests may be served or delivered under this chapter. The city manager shall be notified of the location of such office or any change thereof.

    (c)

    A grantee shall keep a complete and accurate set of books of accounts and records of its business and operations in the city in accordance with generally accepted accounting principles, under and in accordance with this chapter and franchise for the preceding four (4) years under the franchise.

    (d)

    The city shall have reasonable access to all books of accounts and records of a grantee necessary for the purpose of ascertaining the accuracy of any and all reports required under this chapter or necessary to the enforcement of the franchise or chapter. Such records will be made available to the city within thirty (30) business days of a request for such records by the city. The records will be made available at the grantee's office in the city.

    (e)

    Any willfully false entry in the books of account or records of a grantee, or false statement in the reports to the city, knowingly made by a grantee shall constitute the breach of a material provision of the chapter and franchise.

    (f)

    Upon request, copies of the grantee's schedule of charges, contract or application forms for basic cable service, policies regarding the processing of subscriber complaints, delinquent subscriber disconnect and reconnect procedures and any other terms and conditions adopted as a grantee's policy in connection with its subscribers shall be provided to the city.
