§ 6-12. Aircraft parking—Generally.

  • (a)

    General: Aircraft shall be parked only in those public areas specifically designated for that purpose by the city. It shall be the responsibility of the owner or pilot to see that the aircraft is properly chocked and tied down. The operator shall furnish adequate tie-down anchors for this purpose, which shall be equivalent to appropriate Federal Aviation Administration specifications.

    (b)

    Inoperative/disabled aircraft: Despite any other provision herein contained, no inoperative or disabled aircraft shall be parked or maintained for any unreasonable length of time. For this purpose, any aircraft not currently certified as airworthy under appropriate regulations shall be presumed inoperative or disabled. Aircraft registered and certificated by the Federal Aviation Administration but in a continuing process of overhaul and/or repair shall not be considered inoperative. Aircraft in final assembly in preparation for airworthiness certification shall not be considered inoperative. The airport director shall report any inoperative aircraft located on the airport to the city and the owner shall be given written notice of at least thirty (30) days to remove same from the airport property or to place such aircraft in an airworthy condition, which notice shall also be attached physically to the aircraft in question. Thereafter, unless the owner of such aircraft shall have complied with the terms of such notice, the subject aircraft may be towed from the airport by the city or otherwise removed, the costs of such removal and storage to be made against the aircraft owner; provided, however, such owner may, be granted a hearing within said thirty-day period before the airport director to show cause why said aircraft should not be removed. In such event and upon showing of such good cause, the airport director may grant an extension of said thirty-day period conditioned that said aircraft and the area surrounding same is kept in a neat, clean, and sanitary condition, and that the owner of such aircraft conforms to such conditions as the airport director might prescribe.
