§ 7-154. Swimming pool contractors; criminal liability.

  • (a)

    It shall be the responsibility of any swimming pool contractor to obtain a valid swimming pool construction permit for the proposed swimming pool prior to commencement of construction of the swimming pool. It shall be the responsibility of any swimming pool contractor to ensure that during the construction of the swimming pool that no violation of the Code of Ordinances of the City of Grand Prairie relating to construction standards and setback limits occurs. Failure to obtain the swimming pool construction permit or violation of any of the Code of Ordinances of the City of Grand Prairie relating to swimming pool construction or violation of any of the building setback limits established under the zoning ordinances of the City of Grand Prairie shall be punished by a fine in an amount of not less than one hundred dollars ($100.00) and not more than one thousand dollars ($1,000.00). It shall be no defense under this subsection that the swimming pool contractor has received the swimming pool contract by assignment from another swimming pool contractor.

    (b)

    For purposes of this section, the term "swimming pool contractor" shall mean any person, corporation, association, partnership, joint venture or any other legally cognizable entity which is primarily responsible for the placement or construction of a swimming pool.

    (c)

    A determination by any court of competent jurisdiction that the swimming pool contractor is in violation of this section shall not relieve the owner of the property upon which the swimming pool is situated from any criminal liability for the condition of the owner's property.
