§ 7-171. Violations.
(a)
Any gravel pit or excavation, as defined in this article, within the city and not complying with the provisions of this article is declared to be a hazard to public health and safety.
(b)
Any violation of the provisions of this article shall be deemed a misdemeanor and shall be punishable by a fine of not less than two hundred dollars ($200.00) nor more than two thousand dollars ($2,000.00); and each day that such violation exists shall be deemed a separate offense.
(c)
Any gravel pit or excavation found in violation of this article shall be subject to an injunction by the city, such remedy to be cumulative and not exclusive.
(d)
The application of any person, firm or corporation found operating a gravel pit or excavation without a permit, as required herein, shall not be accepted; nor shall such person, firm or corporation receive a permit for the operation of a gravel pit for one (1) year from the date the illegal operation ceases.
