§ 7-171.3. Excessive dust from gravel pits, motor vehicles.

  • (a)

    It shall be unlawful for any person, association, partnership, corporation or other legal entity which owns, operates, manages or controls any gravel pit, as defined in this article, to cause or allow to be caused excessive dirt or dust to be thrown into the air as a result of the operation of the gravel pit. For purposes of this subsection, "excessive dirt or dust" shall mean the suspension of solid particles of dirt, dust, rock or any mineral in the air to such a degree that the suspension of the particles in the air either:

    (1)

    Becomes a hazard to the health and safety of persons working on the gravel pit or a hazard to the health and safety of adjoining property owners; or

    (2)

    Becomes a nuisance to adjoining property owners.

    (b)

    It shall be unlawful for any person, association, partnership, corporation or other legal entity which owns, operates, manages or controls any dump truck, truck, car or other motor vehicle which is driven either to pr from a gravel pit, as defined in this article, to cause, or allow to be caused, excessive dirt or dust to be thrown, into the air as a result of the operation of any dump truck, truck, car or other motor vehicle. For purposes of this subsection "excessive dirt or dust" shall mean the suspension of solid particles of dirt, dust, rock or any mineral in the air to such a degree that the operation of the dump truck, a truck, car or other motor vehicle becomes a hazard to the health and safety to the public or becomes a nuisance.
