§ 30-11. Authority to grant franchise; criteria for granting.

  • (a)

    After the council examines all applications to assure the legal, financial, technical, and character qualifications of an applicant to provide cable service, the council may, after a full hearing, grant a franchise conveying the right to construct and operate a cable system within the city's public ways. A franchise will be awarded to any applicant who, in the council's judgment, will serve the public interest and whose construction and financial plans and arrangements are both feasible and adequate to fulfill the conditions set forth in this chapter and incorporated into any franchise granted.

    (b)

    The council is further authorized to award additional franchises, if it finds that the public welfare will be enhanced by such awards, after a public hearing. Additional franchises will be awarded based upon testimony concerning economic considerations, the impact on public convenience, public needs, potential benefit and other relevant factors.

    (c)

    No provisions in this chapter shall be deemed or construed to require the council to grant a franchise following receipt of any franchise application.
