§ 23-30. Same—Surety bond.
No excavation permit shall be issued to any person in the city, until such person shall have filed with the city a bond in the sum of one thousand dollars ($1,000.00), with good and sufficient sureties, to be approved by the city attorney. In the event a bonded franchise company does the work, it shall be required to file only one (1) bond. The conditions of such bond shall be that the applicant:
(1)
Shall perform all work in a good and workmanlike manner in strict accordance with city specifications.
(2)
Shall backfill any excavation in any public places, so as to return them to their original condition.
(3)
Shall place and maintain lights and barricades around all excavations, materials and equipment left on a public place, and;
(4)
Shall hold the city harmless from all damages, real or asserted, that may occur by reason of the excavation for which such application is made.
